| Fair Labor Standards
Act |
| A Federal law covering hourly employees.
It requires that time and one-half be paid for all hours worked
over 40 hours per week. (There are some tricky calculating methods.)
Certain groups of employees are exempt, such as computer programmers,
straight salary employees, etc. |
| To what businesses
does it apply? Any business that... |
| |
- Has gross annual income of $500,000 or more.
- Does business in interstate commerce.
|
| What are the time
keeping requirements? |
| |
The employer is responsible for insuring accurate
time records. Employers are required to retain time and pay records
for three (3) years. |
| Who enforces
it? |
| |
Violations can be enforced by the government or
the employee (via lawsuit). The government can conduct an audit
of the firm's time records. If non-compliance is discovered, the
employer must comply and pay back wages. |
